1. Acceptance of Terms

By downloading, installing, or using the Nyaya application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User") and Nyaya ("we," "us," or "our"), the developer of the Nyaya application.

2. Description of Service

Nyaya is a legal reference application that provides:

• Reference content from Indian laws including the Bharatiya Nyaya Sanhita (BNS) 2023, Indian Penal Code (IPC) 1860, and related statutes
• AI-powered legal situation analysis and chatbot assistance
• Know Your Rights information
• Guided case journey tools
• Search and browse functionality for legal sections

4. Eligibility and User Obligations

You must be at least 13 years of age to use this App. By using the App, you represent that:

• You are using the App for lawful purposes only
• You will not attempt to reverse engineer, copy, or redistribute the App's content
• You will not use the App to facilitate any illegal activity
• You understand the limitations described in Section 3 above

5. In-App Purchases and Subscriptions

Nyaya offers optional premium subscriptions ("Nyaya Premium") through Apple App Store or Google Play Store in-app purchases.

• Billing: Subscriptions are billed through your App Store or Google Play account on a recurring basis (monthly or annual, as selected).
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your device's subscription management settings. Cancellation takes effect at the end of the current billing period.
• Refunds: All purchases are subject to the refund policies of Apple App Store or Google Play Store. Nyaya does not process refunds directly.
• Free Tier: Free users receive a limited number of AI queries per day. Limits are subject to change with reasonable notice.

6. Intellectual Property

All content within the App, including the user interface, design, branding, and AI models, is owned by or licensed to Nyaya and is protected by applicable intellectual property laws.

Legal text reproduced from statutes (BNS, IPC, etc.) is sourced from government publications and is in the public domain. Translations and summaries of such content are original works of Nyaya.

You may not reproduce, distribute, modify, or create derivative works of the App's proprietary content without prior written consent from Nyaya.

7. User-Submitted Content

If you submit translation suggestions or corrections through the App's community contribution feature, you grant Nyaya a non-exclusive, worldwide, royalty-free licence to use, reproduce, and incorporate such contributions into the App for the purpose of improving legal content accuracy.

You confirm that any submitted content is accurate to the best of your knowledge and does not infringe third-party rights.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Key points:

• We do not require account creation to use the App
• AI queries may be processed by third-party AI providers subject to their privacy policies
• Usage analytics may be collected to improve the App

9. Limitation of Liability

To the maximum extent permitted by applicable law, Nyaya shall not be liable for:

• Any reliance on legal information or AI-generated content in the App
• Decisions made based on App content that result in legal, financial, or personal harm
• Errors, omissions, or inaccuracies in legal content
• Interruption or unavailability of the App or its features
• Any indirect, incidental, special, or consequential damages

The App is provided on an "as is" and "as available" basis without warranties of any kind.

10. Indemnification

You agree to indemnify and hold Nyaya harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the App, violation of these Terms, or violation of any rights of a third party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through in-app notifications or an updated "Last Updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or any applicable law. Provisions of these Terms that by their nature should survive termination shall survive.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.
